These Terms of Service explain how Cardmine works as a trading-card marketplace, what buyers and sellers must do, how payments and disputes are handled, and which rules apply to listings, content and accounts.
1. Who we are and how these terms apply
These Terms of Service govern access to and use of Cardmine, including card data, price history, user accounts, listings, marketplace checkout, messaging, order management and support features.
By creating an account, listing a card, buying a card, using checkout or otherwise using Cardmine, you agree to these terms and to any policies linked from them, including the Privacy Policy and Help Center guides for fees, shipping and Buyer Protection.
Cardmine is a marketplace platform for trading cards. Unless Cardmine is expressly shown as the seller of a specific item, Cardmine is not the seller, buyer, owner, manufacturer, grader or authenticator of cards listed by users.
The platform operator is referred to as Cardmine, we, us or our. If legal entity details are required for a transaction, tax, complaint or regulatory purpose, they will be provided in the relevant account, order, invoice, legal notice or support flow.
2. Account eligibility and account security
You must be at least 18 years old, or have permission from a parent or legal guardian, to use Cardmine. You may not use Cardmine if you are legally barred from doing so or if we previously suspended or terminated your account for serious misuse.
You must provide accurate account, contact, payout, tax and shipping information where requested. You are responsible for keeping your login details secure and for activity that happens through your account unless caused by our own security failure.
We may request identity, business, payment, tax, address or trader verification before allowing selling, payouts, high-value orders or certain marketplace features. Refusing or failing verification may limit your account.
3. Buyers: ordering, payment and receiving cards
When you place an order, you authorize the total shown at checkout, including item price, shipping, payment costs, service fees, taxes where applicable and any other clearly disclosed charges.
A purchase contract is formed between the buyer and the seller when the order is accepted through the Cardmine order flow, unless the listing or checkout clearly states that Cardmine is the seller. Cardmine may facilitate payment, order records, support and Buyer Protection, but does not automatically become a party to the sale between users.
You must use the correct delivery address, respond to reasonable support requests and inspect delivered cards promptly. If something is wrong, open a support case through the order flow and keep photos, packaging, tracking and communication available.
You may not request chargebacks, payment reversals or off-platform refunds before using the Cardmine support process, unless required by law or your payment provider rules. Misuse of chargebacks may lead to account restrictions.
4. Sellers: listings, authenticity and fulfilment
You may only list cards that you own, are allowed to sell and can ship within the handling time shown on the listing or order page. Listings must be accurate, lawful and not misleading.
Each listing must describe the correct card, set, number, language, finish, condition, grading status, quantity and any material defect. Photos must show the actual card where the listing flow requires it, especially for higher-value, graded, damaged, signed, altered or unusual cards.
You are responsible for authenticity. Counterfeit, proxy, resealed, stolen, altered-without-disclosure or otherwise infringing items are not allowed. If a card is custom, altered, signed, stamped, miscut, damaged or not tournament/legal-standard where that matters, disclose it clearly.
You must package cards safely, ship using the selected shipping method, provide tracking when required and mark the order accurately. You may not ask buyers to pay outside Cardmine, change the shipping method without consent, or cancel orders to avoid fees or price movements.
Professional sellers and traders are responsible for complying with consumer, tax, product safety, import, export and information obligations that apply to them. This may include providing trader identity details, VAT or tax information, withdrawal rights where applicable and complaint handling information.
5. Fees, payments and payouts
Fees are shown before checkout or before the relevant seller action. Current fee explanations are available in the Help Center. We may change fees prospectively, but we will not retroactively increase fees for an order that has already been paid.
Payments may be processed by third-party payment providers such as Stripe. Payment providers may apply their own terms, onboarding checks, risk controls, payout holds, sanctions screening and dispute procedures.
Seller payouts may be delayed, held, reduced, reversed or offset where needed for refunds, chargebacks, suspected fraud, verification, negative balances, legal compliance, payment provider requirements or unresolved order disputes.
You are responsible for your own taxes, duties, customs costs and reporting obligations unless checkout expressly states that a tax is collected and remitted by Cardmine or a payment partner.
6. Shipping, risk and delivery issues
Available shipping methods, letter mail limits and tracked-shipping requirements are explained in the Help Center shipping and Buyer Protection guides. Sellers must use the shipping option selected in the order unless the buyer and Cardmine support approve a change.
If a seller fails to hand off or ship an order after a Cardmine-provided shipping label has been created, Cardmine may refund the buyer and recover unreimbursed label or carrier costs from the seller's wallet balance, future payouts or manual account review.
Untracked letter mail is cheaper but has limited delivery evidence and limited postal-loss coverage. Tracked shipments give better evidence for delivery disputes and may be required for higher-value, graded, bulky or cross-border orders.
Risk allocation between buyer and seller may depend on the shipping method, seller type, destination, applicable consumer law and the outcome of the Cardmine support review. Nothing in these terms removes mandatory consumer delivery rights.
7. Buyer Protection, cancellations and disputes
Buyer Protection is a platform support policy, not insurance and not a guarantee that every issue will be refunded. Eligibility, exclusions and evidence requirements are explained in the Help Center Buyer Protection guide.
Cardmine may review order records, listing details, messages, tracking, payment information, photos, packaging, seller history and buyer history. We may ask either party for evidence and may decide to refund, partially refund, release funds, return an item, require additional verification, cancel an order or restrict an account.
Orders or claims may be denied where the transaction moved outside Cardmine, evidence is missing, the complaint is late, the issue is minor or within normal condition tolerance, the buyer changed their mind after correct shipment, or either party acted fraudulently or abusively.
Our support decision does not prevent either party from using mandatory legal rights, payment-provider rights, consumer-law remedies or court procedures where available.
8. Consumer rights and trader sales
Some sellers may be private individuals and some may be professional traders. Consumer rights can differ depending on whether the seller is a trader, where the parties are located and what law applies.
If a professional trader sells to a consumer, the trader is responsible for giving legally required pre-contract information, honoring mandatory conformity rights and providing withdrawal rights where those rights apply. Private seller transactions may not include the same statutory consumer protections.
Cardmine may provide tools to display trader information and support consumer-rights workflows, but sellers remain responsible for the legal accuracy of their own trader status, tax details, return information and consumer notices.
Nothing in these terms limits rights that cannot be waived under applicable consumer law.
9. Prohibited items and prohibited conduct
You may not list, buy, sell or promote counterfeit cards, stolen goods, resealed products sold as sealed, unauthorized proxies sold as genuine, illegal goods, infringing goods, unsafe products or items that violate platform rules or applicable law.
You may not manipulate prices, create fake transactions, scrape or overload the service, use bots without permission, interfere with other users, evade fees, evade suspensions, abuse referrals, launder money, submit false evidence, harass users or move transactions off-platform.
We may remove listings, hide content, block checkout, delay payouts, cancel orders, suspend accounts, report illegal activity, preserve evidence or take other proportionate action where we believe these rules or the law are being violated.
10. User content, moderation and complaints
Users may upload or submit listings, photos, descriptions, messages, reviews, profile information and other content. You keep ownership of your content, but grant Cardmine a worldwide, non-exclusive, royalty-free license to host, store, copy, display, adapt and use it as needed to operate, promote, secure and improve the service.
We may moderate content and accounts using automated signals, manual review or a combination of both. Moderation may consider listing accuracy, fraud risk, counterfeit risk, user reports, legal notices, payment safety, policy violations, sanctions screening, spam signals and marketplace safety.
If we remove content, restrict visibility, suspend an account or take similar action, we will provide information where required and where doing so would not create security, fraud-prevention, legal or safety risks. Users may contact support to challenge a moderation or marketplace decision.
Reports of illegal content, counterfeit goods, intellectual-property infringement or unsafe conduct can be sent through the contact or support channels. Notices should include enough information for us to identify the content, understand the issue and contact the reporting party if needed.
11. Pricing data, card data and availability
Cardmine may show market prices, price history, estimated values, set data, card images, rarity, marketplace listings and third-party data. This information is provided for convenience and may be delayed, incomplete, inaccurate or unavailable.
Pricing data is not financial advice, investment advice, a valuation guarantee or a promise that a card can be bought or sold at a displayed amount. You are responsible for your own buying, selling and collecting decisions.
We may update, correct, remove, merge or reclassify card records, sets, prices, listings or metadata at any time where needed for accuracy, licensing, performance or marketplace integrity.
12. Intellectual property
Cardmine, the Cardmine brand, site design, software, marketplace flows, original text, database structure and platform features are owned by Cardmine or its licensors and are protected by intellectual-property laws.
Trading card names, artwork, game names, logos and related marks may belong to their respective rights holders. Cardmine is not endorsed by or affiliated with those rights holders unless expressly stated.
You may not copy, resell, reverse engineer, mirror, bulk download, scrape or commercially exploit Cardmine content or data except as allowed by the service, an API agreement, written permission or applicable law.
13. Service changes, availability and beta features
We may add, change, pause or remove features, games, pricing sources, checkout options, shipping methods, fee models, seller tools and support flows. Some features may be beta, experimental or region-limited.
We try to keep Cardmine available, secure and accurate, but we do not guarantee uninterrupted access, error-free data or permanent availability of any specific feature, listing, price source or marketplace integration.
14. Liability
To the maximum extent allowed by law, Cardmine is not liable for indirect loss, lost profits, lost data, reputational damage, missed investment gains, market price changes, user-to-user disputes, seller misrepresentations, postal delays, third-party service failures or issues caused by information supplied by users or third parties.
Nothing in these terms excludes liability for fraud, intentional misconduct, death or personal injury caused by negligence, or any liability that cannot legally be excluded or limited.
Where Cardmine can legally limit liability, our total liability for a claim will be limited to the greater of the fees paid to Cardmine for the relevant order or EUR 100.
15. Suspension and termination
You may stop using Cardmine at any time. You remain responsible for open orders, unpaid amounts, chargebacks, returns, disputes and legal obligations that arose before termination.
We may suspend or terminate access, restrict selling, remove listings, hold payouts or close an account where reasonably necessary for marketplace safety, legal compliance, fraud prevention, payment safety, repeated complaints, serious policy violations or abusive behavior.
Before taking long-term account action, we will consider proportionality and available context where practical, unless urgent action is needed to prevent harm, fraud, legal exposure or misuse of the platform.
16. Changes to these terms
We may update these terms to reflect new features, legal requirements, marketplace risks, payment provider rules or business changes. The Last updated date shows when the latest version was published.
For material changes that negatively affect existing users, we will take reasonable steps to provide notice. Continued use of Cardmine after the effective date means you accept the updated terms. If you do not agree, you must stop using the affected service.
17. Governing law and disputes with Cardmine
These terms are governed by the laws of the Netherlands, except where mandatory consumer law gives you additional rights or another mandatory law applies.
If you have a complaint, contact Cardmine support first so we can try to resolve it informally. If we cannot resolve it, disputes with Cardmine may be brought before the competent courts in the Netherlands, unless mandatory consumer rules allow or require another forum.
User-to-user sales may be governed by separate mandatory laws depending on the buyer, seller, trader status, delivery country and transaction details.
